Palestine ignored

A UN report says the Israeli separation wall is an example of Tel Aviv's abuse of international humanitarian law [GALLO/GETTY]

Richard Falk, the UN special rapporteur on the human rights situation in the Palestinian territories, recently delivered his report to the General Assembly.

He cited continued "abuse of international humanitarian law" associated with the "separation wall", "children fatalities due to Israeli use of excessive force" to quell nonviolent demonstrations, and abuses at border crossings.

Despite the details and warnings in the report, Israel's policy of incarceration, targeted assassinations, and near starvation of millions of Palestinians has gone unabated for too long under the eyes of the international community. 

This is the longest occupation (and refugee problem) since the establishment of the UN itself; four decades old … and counting.

Failure to resolve the Palestinian-Israeli conflict and "Israel's 40-year occupation" would, in the words of Kofi Annan, the former UN secretary general, "continue to hurt the reputation of the United Nations and raise questions about its impartiality".

Israel has disregarded with total impunity dozens of UN resolutions "censuring", "calling", "urging", "recommending", or "condemning" its attacks, settlements, deportations, and occupation.

Unfortunately, all pleas and demands for humanitarian and political interventions have fallen on deaf ears. 

Israel has managed to exploit the short-sighted framework of the peace process to bypass all relevant Security Council resolutions such as 465 of 1980 that strongly deplored all measures taken by Israel to change the physical character, demographic composition, institutional structure, and status of the Palestinian and other Arab territories - including Jerusalem- occupied since 1967.  

It also rejected resolution 476, which reaffirmed the necessity to end Israeli occupation of Arab territories. 

Resolution 242 of 1967 has been the only resolution that was accepted by the US and Israel as the basis of the diplomatic process, but this has been systematically violated.

Annual Israeli reports on settlement activity have shown that they have been expanding despite relevant UN resolutions warning of the "inadmissibility of Israel’s acquisition of territory by force".

Recently the Israeli government announced new expansions of its illegal settlements; according to Israeli reports and despite official claims to the contrary, illegal Jewish settlement has accelerated at unprecedented pace under the government of Ehud Olmert, the prime minister.  

This has led to a tripling of illegal settlements since the so-called peace process started in 1991.

In his report, Falk said:

"The extent of the settlement encroachment on West Bank and East Jerusalem territorial scope is difficult to calculate with precision due to the continuous process of expansion."

"The prevailing best estimate is that settlement land claims (together with Palestinian land seized for the construction of the separation wall) confiscate 14 per cent of the territory of the West Bank, which is itself only 22 per cent of the original British Mandate of Palestine."

According to recent figures there are currently some 200 settlements, 100 outposts, and 29 Israeli military bases.

The cost of sustaining the settlement network is about $556 million a year, and the number of settlers is estimated to be between 480,000-550,000.

The rate of settlement expansion is placed at approximately four per cent per year, both with respect to land and population.

There are a variety of special problems raised by the settlements that contribute to violence of settlers toward Palestinians and the violence of Palestinian resistance.

The city of Hebron has been a persisting flashpoint where 700 settlers are protected by 300 Israeli soldiers in a city of 150,000 Palestinian inhabitants.

Perhaps, the most telling statistic compiled by the UN Office for the Coordination of Humanitarian Affairs in the Occupied Palestinian Territories is that Palestinian land taken by Israel for settlements, for closed military zones (including almost the entire Jordan Valley), and for Israeli-declared nature preserves, now renders 40 per cent of the West Bank inaccessible and unusable for residential, agricultural, commercial, or municipal development."

Since the early 1970s, Washington has vetoed 42 UN Security Council resolutions critical of Israeli policies, some of which were drafted by its European allies. 

If one accepts the claim that Cold War rivalries had contributed to UN paralysis with respect to the Israeli Palestinian-Arab conflict, (all 690 Soviet-Arab resolutions adopted from 1947-1990 have been ignored by the West), then how can one justify sidelining the UN since the fall of the Soviet Union? 

After all, most major post-Cold War conflicts have seen direct UN involvement: Bosnia, Kosovo, Somalia, Kuwait, Iraq, Afghanistan, Iran, Syria and of late, Lebanon and Sudan.  

But the UN, it seems, cannot deal with the occupation and suffering of Palestine.

Following the end of the Cold War, the Palestinian-Israeli conflict was removed from the halls of the world body and entrusted to Israel's allies in Washington. 

The few resolutions critical of Israel that were not vetoed by Washington have been utterly ignored by Israel.  

Only when the peace process failed to yield a solution did the Bush administration allow the UN to join the management of the so-called peace process,  and even then, merely as a junior partner in a newly formed International Quartet that includes the European Union and Russia, all of whom are already members of the UN. 

UN is necessary

The only time the UN was allowed a role was in 1997 when it sent a few international unarmed observers to the occupied city of Hebron; but they weren’t mandated to speak publicly about the ongoing violations.

Paradoxically, Israel itself was created by a 1947 UN recommendation for partitioning Palestine, and was accepted as a new UN member on the basis of its commitment to respect its resolution, and specifically the non-binding General Assembly resolution 194 regarding the return of Palestinian refugees.

In the 60 odd years since, Israel has done all but comply with resolution 194 despite its reaffirmation and reiteration dozens of times since.

A quick look at today's Middle East makes it clear that such obstructions of international law and marginalisation of the UN served neither party and did not help the pursuit of peace and security in the region.

But what would a UN role be and how would it contribute to peace in the region? 

After bilateral negotiations and unilateral venues tried and failed to reach a just solition, the multilateral and legalistic UN approach should be given a chance.

A step in the right direction would be to convene an all-encompassing international conference that addresses all aspects of the conflict.

Palestine deserves the same UN-approved international protection afforded to other suffering peoples of the world.  

Perhaps the Security Council could begin by reading Falk's urgent recommendations to end the occupation and arrive at a just solution to the conflict, beginning with the need for Palestinian self- determination.

Falk's recommendations

In his report, Falk urged that the General Assembly should ask the International Court of Justice for legal assessment of the Israeli occupation of Palestine territory from the perspective of the Palestinian right of self-determination.

He also suggested that Security Council assistance should be sought to seek implementation of the 2004 International Court of Justice Advisory Opinion on the legal consequences of the construction of a call in Occupied Territory. 

More pointedly, Falk also shed light on "persisting gross violations of the Geneva Conventions over a long period of time". He called for "serious consideration should be given to the legal obligations of the Parties to these treaties 'to ensure respect' for the substantive undertakings as called for in common Article 1 [of the UN Charter]".

Falk also said: "An initial step might be to urge the Government of Switzerland as repository for the Geneva Conventions to convene a meeting of State Parties with the purpose of exploring how to carry out their legal duties, given the persistent and severe violation of the legal regime of occupation by Israel."

He also urged that "serious note should be taken by all relevant agencies of the United Nations of the failure of Israel to fulfil its pledges at the Annapolis Summit to halt settlement expansion, to ease freedom of movement on the West Bank, and to attend to the humanitarian needs of the Palestinians under occupation."

Finally, Falk placed the onus on the UN as an international body mandated to "explore its own responsibility with respect to the wellbeing of the Palestinians living under unlawful conditions of occupation, particularly bearing on abuses of border control, freedom and independence of journalists, and the general crisis in health care, especially in Gaza." 

The special rapporteur also emphasised the humanitarian and health crisis in Gaza after more than a year of an Israeli siege,

He said that it should be the UN's highest priority to resume economic assistance to the people of Gaza.

He said: "In the face of an impending humanitarian catastrophe, the responsibility to do what is possible to mitigate human suffering is serious."

"This is a responsibility toward the civilian population of Gaza, and is not dependent on whether Hamas satisfies the political conditions set by Israel or whether the ceasefire holds."

Mr Bishara puts his finger on the mind-boggling blindness of many in the West to a colonial situation, created by Western powers, that will ultimately come back to haunt them. Occupying other people's lands can only be permanent if the local population is completely and carefully exterminated : the US is founded on one such feat that practically succeeded. Otherwise, consider History and its protracted timeline. The Arabs occuped Spain for 800 years, and still got kicked out. Thank you.

I believe that Israel is being unjust by taking over Palestinian land because after the second world war it the Palestinian who gave the Jews a living space in their own land whilst the rest of the world were just thinking of their own country. I think Jews were lucky to have this. So now the ‘Orphan Jews’ think they have the right to what they do to other peoples property. I believe UN in its current state which is being used and abused by just few countries should be abolished and NU security council should be dismantled. UN has become a tool and partner for either supporting genocide in palistine, Iraq, afghanistan where it seems that it can not do nothing aganist all the atrocities commited by Isreal and USA. But when it comes to a Muslim country or a country like north Korea or Zimbabwe all of a sudden the humanity of the UN wakes UP. Shame on you UN.

The Palestinians and maybe Arabs in general are engaged in wishful thinking. What they can't get by force they hope that some "shining knight" such as the UN will get for them. They choose to ignore the reality of the situation.The plausible solution would have Palestinian refugees going to the new Palestinian state, Arab neighbourhoods of Jerusalem to Arabs and Jewish ones to Jews and major West Bank settlements traded for other territory. Otherwise,people are really just engaging in delusions.

If It Happened Here
This is definitely the best article I have ever seen about Palestine, and one of the best of Aljazeera's. I think we Canadians and Americans would likely feel some level of discomfort if another country were to come into our own and take over. Perhaps we would protest too. We might even be slow in shrugging our shoulders and accepting the invaders as our good friends. "Okay, you take that half of New York." No, we might not really enjoy that.

Arab nations provide moral support but the US and EU are the main donors of financial aids to palestine, I would like to see more supports from rich arab states in term of money. The irony is, palestinians are discriminated among the Arab neighbours too, egypt restricts its border with palestine, palestinian refugees in Lebanon, Jordan etc are not allowed to work or get PR and their movement restricted.They shd be entitled to proper human dignity like any free man.

this article is bias, to say the least. there's no doubt about the fact that Pal's suffer, and that the occupation is not Disneyland, but you have to be there to know what you're talking about, and what's said here is an exaggeration. no one is being starved, and the Palestinians govern their own cities. they had elections that where more democratic and open then in any Arab state, and in the west bank they have no shortages.

The reason Palestine is ignored is because it does not exist and never really did. Most of what was once called Palestine is now Jordan which was never more than the name of a river. The reason these people suffer is because of people like Marwan and this thinking that refuses to recognize the right of the Jewish people to their own country on their own land and condones barbaric acts of terrorism to evict them from their country. There is no such thing as Palestinian land and never has been.

The title says it all. I respect the author of this article, and praise the people who allowed this article to be released to the press. Mankind must come together to solve this conflict. Solving this conflict will resolve a lot of other issues throughout the middle east the the rest of the world. The Palestinians say they will be happy with the 1967 borders, which is about 20% of what they originally had. But this is not good enough for Israel. Israel wants every last bit of Palestine. All the muslim countries never expelled the jews, they left to settle in Palestine. Muslims even let Jews return to palestine after the muslims defeated the Crusades when the catholics killed all the muslim and jews in Jerusalem. The 'huge' arab world has never attacked israel, rather they have have responded as best they can to repeated and continued agression and provocation from israel and the US. No jews have been expelled from arab states, indeed large numbers of jews continue to live and and thrive in many arab countries enjoying freedoms and properities that israel denies to the arabs whose land it illegaly occupies - large numbers of jews for example live happily in iran.

In 638 CE, Caliph Omar Ibn al-Khattab and Safforonius, the Byzantine governor of Jerusalem, signed The Umariyya Covenant, an agreement that stipulated the rights and obligations of all non-Muslims in Palestine. Jews were permitted to return to Palestine for the first time since the 500-year ban enacted by the Romans and maintained by Byzantine rulers. I wish the Jews would show the same decency, they could really learn a lot about pious behaviour to others from Islam. God willing they will learn

It is significant that my feedback will be the first from Australia - which, after the US, would be Israel's closest supporter - just as 40 years ago, it was one of the last western supporters of the Apartheid regime in South Africa. As one involved in the struggle to change that relationship, I will continue to work with others to challenge the complicity of our recent Governments in ignoring the plight of the Palestinians and the injustices inflicted on them.

It's an utter disgrace that the UN doesn't do anything to solve the humanitarian crisis in Gaza and the West Bank - not to mention the bigger problem of the Israeli occupation and siege. It needs to end, and it needs to end NOW. Israel will only do its enemies a favour by continuing to violently oppress the Palestinians. If they want peace, they can get it. But they want more land instead of peace. A terrible shame for both peoples.

First the writer does mention the biggest of all refusals to accept a UN resolution: this was the refusal of the Palestinians and the Arab countries not to accept the UN partition in 1948. This is at the origin of all the problems we are seening now. Second by just looking at the Hamas charter and their violent behaviour towars Isarel it becomes clear that the Palestinians will not be satisfied by anything less than the complete annihilation of the Israel.

What I find interesting is that nobody thinks about the future. Nobody conciders what could happen when the US is no longer able to support Israel. The power of the US is waning fast and it will, in time, no longer be able to provide financial or millitary support to Israel. What will happen to Israel then? Israel has no means of supporting itself as it has no economy (destroyed due to their relentless assault on the Palestinians). The annihilation of Israel is only a matter of time.

In the Holy quran Allah ordered us to enter to Islam properly, but are we following this. All of muslim claim that they are muslim, but is there any sign that they are muslim, do they act as a muslim. If all of our Muslim brother can act as a muslim, if all of muslim can enter Ialam properly than the problem will be slved. It is a shame for muslim that they are unable to feel the pain of other muslim. The facilitated people of Palestine do not want to solve the problem. They are the main enemy.

Your opinion is nothing but wishful thinking. Israel's economy is very strong. Israel is one of the world's top hightech countries. The standard of living is the same as in Western countries. Israel is also militarily very strong and as everyone knows it has nuclear arms. So even if the US is not supporting her anymore Israel can survive and continue to prosper. But your opinion that the US in time will no longer be able to provide support to Israel is in itself wishful thinking.

Adam - the UK helped establish Israel by arming the Arab armies in 1948. The sad fact is that the Arab nations have abused the UN by forcing miriads of anti-Israel votes through - over 1/3 of UN resolutions are anti-Israel - And if you haven't noticed the majority of us want a Palestinian state living side by side with Israel in peace - that is all we ask. As of the West bank being 22% of the original mandate - well (Trans) Jordan is 80% of the land then we are -2%???

You are quite right thaat Israel is strong economically and militarily, thanks to unconditions political support and 3 to 5 billion $ annually from the US as well as financial support to Jordan and Egypt to maintain peace treaties. However, the state of Israel is morally illigitamate, as it was created by ehthnic cleansing and it has held 4 million human beings in captivity, deprived of human rights for 40 years. Zionism contained the destruction of the Palestinian people as its core principle.

It certainly seems as if the U.N. is actually culpable in its defacto support for Israeli war crimes, aparthied, and ethnic cleansing. After shoehorning the Jewish state into the Middle East, the U.N. has turned a blind eye to decades of suffering that it helped to create. This is in stark contrast to the U.N.'s military and economic involvement/ meddling in other parts of the world.
