US 'terror' suspect freed from jail
Al-Arian is now under home detention pending trial for contempt of court [GALLO/GETTY]

A US court has ordered the release of an Arab-American former professor who had been in jail for five years after he was accused of being a Palestinian terrorist.

Sami al-Arian was freed on Tuesday after US immigration officials failed to explain his continued detention pending a trial for refusing to testify before a grand jury about a cluster of Muslim organisations in northern Virginia.

"We are obviously relieved and delighted,'' Jonathan Turley, al-Arian's lawyer, said.

But the former computer engineering professor at the University of South Florida, in custody since early 2003, is not yet fully free.

He must remain under home detention at his daughter's residence in Virginia, pending trial.

In February 2003, federal prosecutors charged al-Arian with being a leader of the Palestinian resistance movement, Islamic Jihad, which the US has labelled a "terrorist organisation".

A jury acquitted him of eight charges out of the 17 against him but was deadlocked on the others.

Al-Arian later struck a plea bargain and admitted to lesser charges of conspiring to aid the group by helping a family member with links to it to get immigration benefits, and by lying to a reporter about another person's links to it.
 
He was sentenced to nearly five years in prison, during which time federal prosecutors sought his testimony for a grand jury investigation.

Last month US District Judge Leonie Brinkema postponed the contempt trial and questioned whether the charges violated the terms of al-Arian's plea agreement which bars the justice department from standing in the way of his deportation after he has served jail time.

Nobody wants a return to the cold war, when the whole world had to worry that the big, playful, idiots in Moscow and Washington would start lobbing nukes at each other. I have to admit though that it had one good point. We tried to live up to our bragging about freedom and democracy to convince the world we were better than the "evil empire" as Reagan called the Eastern block. From the first time Bush Sr. referred to us as the "sole remaining superpower", we've been slipping.

Finally Out of Jail
Prof. Al Arian was never convicted of any of his charges. He refused to cooperate with the witchhunt of the grand jury. He went on several hunger strikes. His daughter, Layla Al Arian, a journalist, worked tirelessly for him. To hear her interview go to www.democracynow.org. My prayers and hopes go to Prof. al Arian and his family. Shame on my government for persecuting this man and his family. This is a dark time for freedom of speech in America.

What a sham! This man was imprisoned for years on a hunch. This is a grave miscarriage of justice. He was clearly targeted for his ethnicity and religion. You can see the despair in his eyes. There is no justice left in America all we have is a hollow shell meant to reinforce the political and corporate elite. My country is falling apart in the hands of ignorant, selfish opportunists. We are the emperor with no clothes.

Al-Arian imprisonment
Five years in jail for helping someone with an immigration problem and lying to a reporter? Insane! It looks to me like this guy's main offense was being an Arab and a Moslem. Don't Prosecutors read the First Amendment? It's hard to imagine anything more opposed to American law and values than allowing theology and/or race to influence civil law enforcement.

Al Arian.
What is this free world/democracy turning into.Ever since Ronald Reagan passed,the US hasn't been the same.The breaking of the Berlin wall was so symbolic and the world seemed it was heading towards a utopian society.Ever since the republican party of 88 took over this world hasn't been the same.We have seen 20 years of invasions,murdering of women and children,jailing innocent people,torturing,racism,sanctions against the common people,the poor and hungry ignored,all for the greed for oil.

Muslim until proven guilty !!
Muslims are being rounded up and sent to prison in the west specially US just for having a Muslim name, having a beard and being from Middle East specially. We have numerous examples of Muslims being imprisoned for 6 or 7 years, and later on freed without charge. I think Muslims are sent to jail just because of being Muslim : "Muslim until proven guilty"

See: we prosecute people for lying to the news media. It's a crime to tell a lie in the US. Insanity of the U.S.
I follow Prof. Sami Al-Arian's update since last year. It was amazing to see the stories on insanity of the. U.S. This country again and again targets people simply because they are muslims, have muslim names, or come from Islamic countries. It's ashamed! America should wait for their fall. This country will be fall apart, destroyed, by its own hatred and insanity. Sooner or later. We'll wait for that. This country, together with Israel, are the great oppressors of the world today!

When did it become a crime to "lie to a reporter"??? I feel sadden that America, my nation, would do this to another American. To the rest of the world, well... that's a difference story, but to an American, no.
