US charity guilty in Hamas case
The verdict came after Holy Land's first trial last year
ended in a mistrial

A US court has convicted a Muslim charity and five of its former leaders on 108 charges in the largest "terrorism" financing trial in US history.

The Texas jury reached its verdict on Monday after eight days of deliberations over whether the former Holy Land Foundation for Relief and Development, once the largest US Muslim charity, had given money to the Palestinian group Hamas.

The charity, which was shut down seven years ago, was accused of giving more than $12m to support Hamas, which was designated a "terrorist organisation" in 1995 by the US government.

The hour-long verdict, following a seven-week trial, came after a first trial ended in October 2007 with one man acquitted on 31 charges but jurors unable to agree on verdicts for others.

Several relatives of those convicted on Monday wept as the verdict was read out in the Dallas courtroom, with one woman shouting "my father is not a criminal".

Ghassan Elashi, Holy Land's former chairman, and Shukri Abu-Baker, the
charity's ex-chief executive, were convicted of a combined 69 charges, including
supporting a specially-designated "terrorist" organisation, money-laundering and tax fraud, The Associated Press reported.

Mufid Abdulqader and Abdulrahman Odeh were convicted on three counts of
conspiracy, and Mohammed El-Mezain was convicted on one count of conspiracy
to support a "terrorist organisation".

The Holy Land foundation itself was convicted on all 32 counts.

'Political' case

While prosecutors said the foundation raised money for Hamas they did not accuse the charity of directly financing or being involved in "terrorist" activity.

Prosecutors said the charity was spreading Hamas's ideology by funding schools, hospitals and social welfare programmes controlled by the group in the Palestinian territories, and permitting it to divert funds to the activities of fighters.

However, the charity's supporters said the government was politicising the case as part of its so-called war on terror and ignoring the foundation's charitable mission in providing aid to the poverty-stricken Palestinian territories.

Government officials had raided Holy Land's headquarters in December 2001, and George Bush, the US president, later announced the seizure of the charity's assets as "another step in the war on terrorism".

But defence lawyers said their clients had been put on trial partly because of their family ties to members of Hamas - Khaled Meshaal, Hamas's political leader exiled in Syria, is the brother of defendant Mufid Abdulqader.

Unidentified Israeli witness

Al Jazeera's Tom Ackerman, reporting from Dallas, Texas, where the court case took place, said a former US state department official testified that he was never told that Hamas directed the US charity during intelligence briefings.

But an unidentified Israeli witness told the court that the aid was funnelled through Hamas channels.

Lydia Gonzalez of the League of United Latin American Citizens, said the defendants did not get a fair trial.

"When you're supposed to be able to face your accusers fully and against secret evidence and secret witness, I think that leads to reasonable doubt."

Muslim groups say the prosecution has made American Muslims more hesitant to fulfil their religious obligation of helping the needy and the foundation's defenders accuse the government of selectively prosecuting the charity.

"The same charities that these guys gave to the American Red Cross is still giving to, the USAID is still giving to," Mustafaa Carroll of the Council on American-Islamic Relations, said.

First, don't hold this trial in Texas of all places. No way that they're going to get a fair trial. Second, one persons terrorist is another persons freedom fighter. By this court's logic, if the Red Cross provides or funds any type of relief or support to people in Isreal, Palestine could hold them for supporting terrorism?

I am disgusted after reading this! All this is going to do is alienate Muslism further. How can you blame a charity for giving funds to Hamas, when Fatah had a horrible reputation for stealing zakat & tax dollars! Mr. Sayfud-Deen is mistaken when he states the US gives $13 billion per year to Israel. Per the Congressional Research Service the top Foreign Aid Recipients, excluding Iraq, in 2004 (latest I could find) were Israel ($3B), Egypt ($1.9B), Afghanistan ($1.8B), Columbia ($0.6B), Jordan ($0.6B), Pakistan ($0.4B). Giving to Islamic countries exceeded giving to Israel. I know several people of Islamic descent. None that I know are the recipient of atrocities by our government.

Maybe Islamic countries receive more in terms of aid, but look at who is getting the money...countries that are proxies of the United States...Jordan and Egypt receive money in return for not attacking Israel...look at Egypt, they have one crossing unpatrolled by Israel to Gaza, yet they don't let aid through either. Afghanistan and Pakistan fight the US war on terror..Pakistan also in part to a peace deal with India and the nuke problems in the 80's/90's..where is the money to Iran and Syria

Funding Trial
The Holy Land was a genuine charity which provided badly needed support to Palestines living in poverty. Hamas is a genuine political party which won the last election. To call it a "terrorist organization" was an immoral political act. I agree with their view that there should be one multi-racial country in Palestine. Does that make me a terrorist? As for the cost of rockets fired into 'Israel', they are cheaply homemade in garages and are not financed or supported by Hamas.

US handle this case against all human rights, but this the American habit. To eliminate unwelcome countries or groups of countries, they name them terrorists and as terrorists they have no right, and for the Americans the problem is solved. It's only sad, that other civilised countries are following the pressure of US. The only way to stop the US is the economic way - a boycott on US-goods.

This case bears no difference from many Federal cases in the US, especially during the Bush regime. Bush and his cronies were dead serious when they said "If you're not with us, you're against us". These people suffer daily oppression and deprivation of food, water, medicines, electricity, freedom to travel for work or hospital appointments, or to visit relatives. They have frequently have their land taken away from them, their olive trees burnt or up-rooted, their houses bulldozed or bombed. The establishment of Israel was through terrorist atrocities. Those that feel this article is unfair should look back at the coverage of Dallas Morning News. It is virtually the same. Should you look back at the sames coverage of the first trial there was a great deal of articles on the "closed court" and how exactly you could get a fair trial when the main witnesses were shin bet agents whose identities "must be protected". Many Texans found that very disturbing.Holy Land was a well respected charity.Like when you call a wall a "fence". Sick.

Where did the date of 1995 come from? Hamas was not declared a terrorist organization until 2003. In the lead up to the invasion of Iraq the State Dept. was resisting declaring Hamas and Hizballah terrorist organisations, presumably in order to minimize opposition to its main goal. I watched on C-Span as a panel of Jewish members of House and Senate badgered Colin Powell to declare them terrorist. Within a few days they got what they wanted. It was in early 2003.

Why does the U.S. government call Hamas a terrorist group and not Iseral. Everytime they lanch a missle from an aircraft at Gaza, that is an act of terror. It kills civilians as well as combatants. Hamass lanches a missle that kills no one and Iseral lches a misle that kills many innocent people. The U. S. needs to get over the collective guilt they have over the Holocaust and realize that Iseral is not a helpless state at th mercy of its neighbors.

In America, to win a court case, you must get the best lawyer. OJ Simpson and Michael Jackson were found "Not Guilty" because the had the best lawyers money can buy. Those convicted can only blame themselves if they went for the cheapest lawyer. "You get what you pay for". This court case must be part of a coordinated Zionist push to cut the life-lines of the Palestinian people. In Britain also, a major charity providing aid to Palestinians is being targetted. A major bank- Lloyds TSB has ordered the Islamic Bank of Britian, for whom it clears funds, to cease dealings with Interpal or face closure. by Dec.8th 2008. As much as you want to blame the courts, I can't believe that anyone is surprised at the outcome. The charity was convicted of giving to an org. which is designated by the US as a sponsor of terror. We can argue about whether or not Hamas should be on this list, but that is not for this court to decide. Since we are a nation of laws, I would not advocate that you break laws simply because you disagree with them. There is a process within the legal framework to change things.

As poorly as these people appear to be treated in the U.S. courts, I don't understand why 6 million muslims still live want to live here. Of all the places in the world to live, why do they live in the U.S? I would never live where I am mistreated, singled out as a terrorist, or could be wrongly convicted of supporting terrorism. Something to think about
America is a democracy. If this court case was put to public referendum, the group would undoubtedly have been convicted. America, as a country, has the right to designate its own enemies (much like Hamas calls for the destruction of Israel). We also have the right to prosecute those who we find to be aiding our enemies. The court did not act contrary to the Constitution or the will of the American people. I can think of no logical reason this decision should be questioned.

To all those who oppose this decision
The impetus is on the Muslim charities to draw a clear line of distinction between their causes and the causes of terrorist groups like Hamas. Self-respecting Muslims should be eager to distance themselves by organizations like Hamas which have caused significant damage to the image of Islam worldwide. If your organization does not find flaw in suicide bombers and launching rockets indiscriminately at towns, then you are not a member of a charity and you shouldn't pretend to be.
