Israel 'breaking law' with Gaza war

The president of the United Nations General Assembly has accused Israel of violating international law with its war on Gaza in which almost 1,100 Palestinians have been killed, nearly half of them civilians.

"Gaza is ablaze. It has been turned into a burning hell," Miguel d'Escoto Brockmann told an emergency session of the UN General Assembly in New York on Thursday.

He said Israel's offensive was "a war against a helpless, defenceless and imprisoned people" and accused Israel of carrying out attacks on civilian targets.

"The violations of international law inherent in the Gaza assault have been well documented: collective punishment, disproportionate military force [and] attacks on civilian targets, including homes, mosques, universities, schools," he said.

He also rebuked UN member-states for their lack of action over the crisis, saying: "The [UN Security Council] may have found itself unable or unwilling to take the necessary steps to impose an immediate ceasefire, but outsourcing that effort to one or two governments, or through the quartet, does not relieve the council of its own responsibilities under the UN charter.

"The council cannot disavow its collective responsibility. It cannot continue to fiddle while Gaza burns."

Ryad Mansour, the Palestinian observer at the UN, called for an independent investigation of Israel's "grave breaches and systematic violations of international law".

"Since this crisis began, it is without a doubt that a multitude of war crimes have been perpetrated by the occupying power [Israel]," he said while also calling for "measures for the protection of the defenceless Palestinian civilian population."

Gabriela Shalev, the Israeli ambassador to the UN, dismissed the session as a "cynical, hateful and politicised [attempt] to de-legitimize Israel's fundamental right to defend its citizens".

The emergency meeting had been requested by the 118-member UN member states making up the non-aligned movement.

An Israeli delegate had sought to block the session on procedural grounds by arguing that under the UN charter the 192-member assembly could not rule on a matter already being tackled by the Security Council, but the move was dismissed.

D'Escoto noted that the Security Council last week had called for a Gaza ceasefire leading to the withdrawal of Israeli forces.

"Prime Minister Olmert's recent statement disavowing the authority of Resolution 1860 [the Security Council resolution] clearly places Israel as a state in contempt of international law and the United Nations," d'Escoto added.

He urged the assembly to agree its own non-binding assembly resolution reflecting "the urgency of our commitment to end this slaughter" in Gaza.

Israel has continued its offensive regardless of the resolution which was also rejected by Hamas.

D'Escoto, a former Nicaraguan foreign minister, told Al Jazeera on Tuesday that Israel's killings of Palestinians in Gaza amounted to "genocide".

Almost 1,100 Palestinians have been killed during Israel's Gaza offensive, which Israel says is to stop Palestinian rocketfire coming from Gaza.

Israel Breaking Law
The Palestinians in Gaza must stand together against all attempts of any other nation or group of people to control your lands, your lives and your beliefs. It is your right as people to live as you choose. My prayers are with you, your children and your leaders

UN yet again has badly failed to stop Israeli terrorism that they managed to keep running for 22 days. These councils are nothing but made to give tickets to strong to jump over weak by making any kind of justification. U.S funded Iraq against Iran then invaded it. Then funded Afghanistan against Russia and then invaded it and now is funding Israel against Palestine and the surrounding Arab world...

Israel is responsible for genocide
How could the whole World not see that the atrocities Israel has committed amount to Genocide? 1300 compared to 13 dead is Genocide, no matter how nice you make the Israeli's sound, their war machine killed and aimed for civilians, how can they justify the use Dime or phosphorous explosives in densely populated areas? They cannot and will not convince us with their propaganda and lies, Israel is responsible for killing innocent civilians and should be held accountable as such.

Israel breaking the law
It is not just a matter of breaking the law but which laws are broken. It would be foolish to reason that as long as countries are breaking laws during wars, it should not matter that Israel is. Israel's terrorism should be stopped.

steve, you really should read history than you may find that the islamic nation under prophet Muhammad (PBUH) and his friends did not break any laws. His friends went into Jerusalem with the shedding of any blood they even allowed the Jews to come back into Jerusalem for worship with full protection. Steve the point is that any nation or person who break the law should be brought to justice. Isreal has been breaking international law from its creation until today and getting away with it.

So what will UN doabout it? Slap Libni's hand? Send her in the corner for "time-out? Take her goverment salary for a month or two? It is obvious that Isreal does not care about what the UN has to say. It bombed its schools in Gaza three times in this conflict.

It so sad that no one is talking about rockets being fired into Isreali populated areas without minding where it may land. talking about war crime? Is fighting and firing rocket in the midst of civilians not a war crime?

Israel Breaking law?
In warfare, one must always assume that there is a dominant power. One must also believe the dominant power will use whatever means necissary, just like the inferior power, to protect their cause. However, when a rock or an old soviet missile is fired at the outskirts of an israeli settlement, and the obviously dominant power retaliates with tanks, many platoons of armed men , and several thousands of bombs one must consider that the dominant power is obviously slightly detached from reality...

Has Hamas and Palestinian factions not committed war crimes by firing rockets at Israel? Have Hamas that controls the territory, not commited war crimes by hiding fighters within civilian areas and using ordinary Gazans as "human shield"

To all the people in the world, imagine the 1000+ people killed in gaza were your mother, brother, sister, and your kids,shame on the Arab nations for not coming to the aid of the palestinian people, Stand up to Israel! Israels right to fight!
Rocket were fired, Israel fired back. It's too bad they fired bigger weapons, ... I'd quit shooting rockets if I were Hamas. Simple formula, but the retaliator has always gotten more blame. Go Israel!!
